Please is case ka kya Answer hona chahiye ye batao...
Ek telecomunication company hai wo apne Dealres Ko Commission pay karti hai aur uspe TDS U/S 194 H deduct karti hai aur telecom. company dealer ke behalf pe direct Sub dealers ko b commssion paid karti hai aur ye commission ki amount dealer ko paid karne wali amount se charge ki jati hai but telecom. company is par TDS nahi deduct karti kya yeh sahi hai?
kya sub dealer ko paid commission par TDS duduct karna chahiye??????? |

on the amount of commission paid to sub dealer commission is to be paid @ 10%. TDS is to be deducted by the dealer. Company is paying on behalf of dealer and deduct the amount of commission pay able to dealer.becasue ultimate liability to deduct TDS is of dealer.

Answer Yes comapny is liable to ded tds on payment made to sub dealer.
As per Sec194 H "Commission or brokerage include any payment received or receivable ,directly or indirectly ,by a person acting on behalf of another person for service rendered9not being professional services) or for any services in the course of buying or selling of goods or services in or in relation to any transaction relating to any assets ;valuable artcle or thing ,not being securities. |
